Taking strong exception over the politics going on in the Hathras incident, renowned lawyer of Patna High Court and activist for the cause of justice Mrs Chhaya Mishra observed that the victim was denied the fundamental rights.
A former joint secretary of the Advocates Association, Chhaya Mishra appealed to the political parties not to exploit the Hathras Shame in the ensuing Bihar assembly elections.
She said the deceased Nirbhaya of Hathras was a victim to the cruelty of the perpetrators of the crime and unfortunately later by the administration. The police did not allow her to have benefits of the Fundamental Right guaranteed under Article 21, she added.
Chhaya Mishra said the right to decent burial and cremation or funeral was commensurate with the dignity of an individual’s right to life in the Fundamental rights. “There was a gross violation of fundamental rights of Nirbhaya of Hathras, who came from a poor and downtrodden socially and economically community,” she said, adding that the victim was denied decent cremation as her body was burnt in the late night hours.
Informing that the Uttar Pradesh Government, Lucknow bench of Allahabad High Court was already concerned over the issue, she said the High Court had even hinted at monitoring the investigations. Court has asked the authorities to ensure presence of Nirbhaya of Hathras parents in the Court on October 12 with the state bearing transportation, lodging, food and security of the family.
Chhaya Mishra urged the Nirbhaya of Hathras must not be allowed to become an election issue and her dignity must be preserved and protected even after death by not even hinting at the incident during the campaign. All political parties should take a pledge to protect the dignity of women in Gandhi jayanti and the best and befitting tribute to her would be to include and guarantee protection to all women in their programmes, manifesto and resolutions.
