Terror on Tracks: Patna High Court rejects bail plea of rail derailment plot accused

A division bench of Patna High Court comprising Justice Ashwini Kumar Singh and Justice P B Bajanthri rejected the bail application of Gajendra Sharma of Ghorasahan in East Champaran district charged by National Investigation Agency (NIA) with conspiracy to blow up railway tracks.

The Court also directed the trial court to complete trial on day-to-day basis in the case related to causing terror on tracks.

NIA special public prosecutor Mrs Chhaya Mishra contested the plea and argued that the bench examination of witnesses was going on and if the accused was granted bail at this stage, witnesses might be influenced by the accused. She said delay in examination of witnesses was hit adversely due to COVID 19 pandemic. Since the courts functioning has been stabilized, the remaining witnesses on behalf of the prosecution will be examined expeditiously.

She told the court that NIA would make all endeavours to examine all witnesses in next nine months. NIA had submitted list of 138 witnesses and till date, 33 have been examined.

Accused was arrested on February 16, 2017.
